A Practical Guide to Identifying, Managing, and Remediating Asbestos in Fill

Asbestos in uncontrolled fill is a common environmental issue on older development, demolition, and construction sites across NSW. Fill may have been imported or placed on a property many years ago without the level of documentation or quality control expected on modern projects.

When that fill is excavated, moved or reused, asbestos-containing material can be uncovered unexpectedly. This can create risks for workers, contractors, neighbouring properties, and the site’s future use.

What is Uncontrolled Fill?

Uncontrolled fill generally refers to material that has been placed on a site without reliable records confirming its source, composition, placement, or quality. It can include:

Why is Asbestos in Fill a Problem?

Asbestos in soil and fill can become a health risk when the material is disturbed.

Excavation, grading, trenching, drilling, landscaping and other earthworks can break asbestos-containing material into smaller pieces or generate contaminated dust. Common situations where asbestos may be uncovered include:

How is Asbestos in Fill Investigated?

A suitable investigation considers the site history, proposed land use, fill conditions, sampling results and the potential for asbestos to be present in other areas.

Depending on the site, an investigation may include:

  • Review of historical site information

  • Site inspection

  • Visual assessment

  • Soil and fill sampling

  • NATA-accredited laboratory analysis

  • Asbestos fragment assessment

  • Mapping of impacted areas

  • Air monitoring

  • Assessment of the extent of contamination

Sampling should be designed around the site conditions and proposed works rather than relying on a one-size-fits-all approach.

Asbestos Fragments vs. Asbestos Fines

One of the most important considerations when assessing asbestos in soil is that asbestos may be present in different forms. Asbestos fragments are visible pieces of asbestos-containing material that can be identified during a visual inspection and confirmed by NATA-accredited laboratory assessment. Asbestos fines refer to smaller asbestos-containing material and fibres that may be present within the soil matrix.

This distinction matters because removing visible fragments alone may not show that the surrounding soil is free of asbestos contamination. A suitable investigation and validation program should consider the nature of contamination and the proposed current and/or future use of the site.

What About Reusing Contaminated Fill?

One of the biggest questions for builders and civil contractors is whether asbestos-impacted fill can be reused elsewhere on the site. This should not be assumed. Moving contaminated soil can spread asbestos across previously unaffected areas and may create additional waste and remediation requirements.

Before moving or reusing fill, the material should be appropriately assessed, and the proposed management approach considered against the relevant NSW Environmental and WHS Requirements. Getting this assessment early can present unnecessary movement of contaminated material and avoid additional project costs.

Asbestos Waste and Disposal

Once asbestos-containing fill is excavated, it becomes a waste management issue as well as an environmental issue. Asbestos waste must be appropriately contained, transported, and disposed of at a facility authorised to receive it. Depending on the quantity and classification of the waste, additional NSW EPA waste tracking requirements may apply.

A remediation program should therefore consider the disposal pathway before excavation begins. This can help avoid situations where contaminated material has already been stockpiled on site, but an appropriate disposal facility or transport arrangement has not been organised.

Validation after Remediation

After remediation, validation may be required to demonstrate that the affected area has been appropriately cleaned and that the remediation objectives have been achieved.

Validation may involve:

  • Post-remediation site inspections

  • Soil sampling

  • Assessment of remaining asbestos fragments

  • NATA-accredited laboratory analysis where required

  • Review of excavation boundaries and depths

  • Photographic records

  • Validation reporting

The level of validation should reflect the nature of the contamination, the remediation approach and the intended future use of the site. For development projects, a clear validation report can provide important evidence for clients, consultants, certifiers and other project stakeholders.
